Introduction

These Terms & Conditions govern the use of the Damp & Mould Solutions UK website and the services provided by Damp & Mould Solutions UK.

By using this website or instructing Damp & Mould Solutions UK to attend a property, carry out an investigation, provide a report or undertake remedial works, the client confirms acceptance of these Terms & Conditions.


Services

Damp & Mould Solutions UK provides specialist property services including, but not limited to, leak detection, damp investigations, mould inspections, mould remediation, structural drying and associated remedial works.

All services are subject to availability, site conditions and access.


Scope of Work

Services provided by Damp & Mould Solutions UK are limited to the specific inspection, investigation, report or remedial works agreed at the time of booking, quotation or written instruction.

Any work identified during attendance that falls outside the original scope may be subject to additional charges and will only be undertaken following client approval.


Quotations

All quotations are based on the information available at the time they are prepared. This may include site observations, customer descriptions, photographs, videos or documentation supplied by the client or third party.

If site conditions differ from those originally described, additional works, time or materials may be required and may be subject to revised charges.

Unless otherwise stated in writing, quotations are valid for a reasonable period only and may be withdrawn or amended if circumstances change.


Acceptance of Quotes

Quotes may be accepted by any of the following methods:

  • written email confirmation

  • WhatsApp confirmation

  • verbal acceptance on a recorded telephone call

  • acceptance through a quote or job management system

  • issue of a works order or written instruction

Acceptance of a quotation confirms agreement to the quoted works, charges and these Terms & Conditions.


Works Orders and Written Instruction

Where instructions are provided by landlords, letting agents, housing providers, block managers or property managers, Damp & Mould Solutions UK requires a formal works order, job instruction or other written authority prior to attendance unless otherwise agreed.

This instruction may be issued by:

  • official works order

  • email

  • property management software

  • WhatsApp confirmation from an authorised representative

The instructing party must ensure that the instruction clearly confirms authority to proceed and acceptance of all associated charges.


Emergency Works

Where emergency attendance is requested, Damp & Mould Solutions UK may, at its discretion, attend the property before receipt of a formal works order in order to reduce risk, prevent further damage or protect the property.

In such cases, the requesting party must provide written confirmation of instruction as soon as reasonably possible and accepts responsibility for all associated charges.

Emergency attendance does not remove the requirement for later written authority, confirmation of client responsibility or payment.


Authority to Instruct

The person or organisation instructing Damp & Mould Solutions UK confirms that they have authority to request attendance, approve investigation or repair works, and accept the corresponding charges on behalf of the property owner, landlord, managing agent or responsible party.

Damp & Mould Solutions UK accepts no liability for disputes arising where an instruction is issued by a person lacking sufficient authority.


Client Information and Accuracy

Where quotations, investigations or appointments are arranged based on information supplied by the client or third party, Damp & Mould Solutions UK is entitled to rely on that information as being accurate.

Where that information is incomplete, misleading or materially inaccurate, Damp & Mould Solutions UK reserves the right to revise the scope of work, charges or recommendations accordingly.


Access Arrangements

The client or instructing party is responsible for ensuring safe and reasonable access to the property and all relevant areas requiring inspection, investigation, drying or repair.

Where instructions are issued by landlords, agents or property managers, full contact details must be provided for the individual who will be present to provide access. This may be the tenant, owner, managing agent representative or another authorised person.

Failure to make proper access arrangements may result in delay, aborted attendance, incomplete inspection or additional charges.


On Route Notification

Where a contact number has been provided, the attending engineer will normally send an on-route message prior to arrival, typically giving between 30 minutes and 1 hour notice.

Where additional notice is requested, Damp & Mould Solutions UK will try to accommodate this where reasonably possible, but this cannot be guaranteed.

It remains the responsibility of the instructing party and access contact to ensure availability at the property.


Waiting Time and Failed Access

Upon arrival, the attending engineer will wait for up to 30 minutes for access to be provided.

If access cannot be obtained within that period, the appointment may be treated as a failed access or abortive visit.

Where attendance takes place and access is not available, Damp & Mould Solutions UK reserves the right to charge for travel time, engineer time, scheduling disruption and operational loss.

Any return visit required due to failed access may be subject to additional charges.


Property Preparation

Clients must ensure that the relevant areas are reasonably accessible prior to attendance.

This may include ensuring that:

  • access panels are available

  • cupboards are cleared

  • affected walls or areas are reachable

  • furniture is moved where necessary

  • baths, sinks, appliances or pipework locations are not obstructed

Where reasonable access is not available, the engineer may be unable to complete the investigation or works in full.


Furniture, Contents and Personal Belongings

Engineers are not responsible for moving large furniture, white goods or personal belongings unless specifically agreed.

Clients should ensure that the work area is suitably prepared before attendance.

Where assistance is provided in moving items, Damp & Mould Solutions UK accepts no responsibility for loss or damage except where caused by proven negligence.

Clients are responsible for protecting or removing valuable, fragile or sensitive items from the working area.


Utilities and Site Conditions

Certain services may require working utilities including electricity, water supply, drainage access, heating systems or internet/mobile signal for reporting purposes.

Where utilities are unavailable, isolated, unsafe or defective at the time of attendance, the scope of investigation or works may be limited and a return visit may be required.

Additional charges may apply where attendance is wasted or materially delayed by site conditions outside the control of Damp & Mould Solutions UK.


Investigation Visits

Leak detection, damp investigations and mould inspections are diagnostic services carried out to identify the most probable cause of an issue using professional judgement, available evidence and industry-standard methods.

Unless otherwise agreed in writing, an investigation visit does not include repair works.

Where appropriate, recommendations may be provided and a separate quotation for remedial works may be issued.


Professional Opinion Statement

Any findings, conclusions or recommendations provided by Damp & Mould Solutions UK are based on the conditions observed and the evidence available at the time of inspection.

The conclusions provided represent a professional opinion formed using industry experience and available testing methods and should not be interpreted as an absolute guarantee of the condition or future performance of the property.


Investigation Limitations

While every reasonable effort will be made to identify the source or cause of a defect, Damp & Mould Solutions UK cannot guarantee that the source of an issue will always be identified during a single visit.

Some problems may be intermittent, concealed, environmental, multi-factorial or outside the scope of non-intrusive testing.

Further attendance, monitoring, intrusive inspection or specialist testing may be required.


Non-Intrusive Inspection

Unless specifically agreed otherwise, investigations are carried out on a non-intrusive basis.

This means that floors, walls, ceilings, boxing, fixtures, finishes or building elements will not normally be opened, removed, dismantled or disturbed without prior approval.

Where the source of an issue cannot be confirmed without intrusive investigation, further exploratory works may be recommended and separately quoted.


Inaccessible and Concealed Areas

Inspections are limited to areas that are safely accessible at the time of attendance.

Damp & Mould Solutions UK accepts no responsibility for concealed defects, hidden leaks, inaccessible voids, enclosed service runs, restricted cavities or defects behind finishes or fixtures that cannot reasonably be inspected at the time of the visit.


Intermittent Faults

Some leaks, moisture issues and faults may be intermittent and may not be active or reproducible at the time of attendance.

Where an issue is not visibly occurring during the visit, conclusions may be limited to the evidence available and further monitoring or re-attendance may be required.


Environmental and Occupancy Conditions

Moisture readings, mould growth, condensation patterns and damp conditions may be influenced by weather, temperature, ventilation, heating use, occupancy levels, drying history, building use and tenant behaviour.

Observations and recommendations reflect the conditions present at the time of inspection only.

Damp & Mould Solutions UK accepts no responsibility for changes in conditions arising after attendance due to environmental or lifestyle factors.


Condensation and Ventilation Factors

Where condensation or mould growth is influenced by occupancy behaviour, poor ventilation, low heating patterns, drying clothes indoors, furniture placement or similar conditions, Damp & Mould Solutions UK may identify these as contributing factors.

Damp & Mould Solutions UK cannot be held responsible for the continuation or recurrence of condensation-related issues where recommended environmental or occupancy changes are not implemented.


Site Testing and Existing Weaknesses

Where testing is undertaken on plumbing systems, heating systems, fittings or components, reasonable care will be used.

However, Damp & Mould Solutions UK is not liable for failure of pre-existing weak, defective, corroded, perished or worn components that become apparent during normal investigation, operation or testing.


Damage During Access or Investigation

Where access to a leak, moisture source or defect requires inspection around fixtures, panels, pipework or surrounding materials, reasonable care will be taken.

Damp & Mould Solutions UK is not responsible for unavoidable disturbance reasonably necessary to inspect or access the relevant area, nor for the discovery of pre-existing defects, poor installation, historic damage or deterioration uncovered during the process.


Reports and Findings

Reports, summaries, findings and recommendations are based on observations made at the time of attendance and the evidence reasonably available.

They are intended to assist the instructing client in understanding the probable cause, extent or recommended next steps relating to the issue investigated.

Reports do not amount to a warranty, guarantee or certification of future performance unless expressly stated otherwise in writing.


Report Release

Where written reports or formal investigation findings are to be issued, Damp & Mould Solutions UK reserves the right to withhold release until the associated invoice has been settled in full.

For repeat and approved clients operating under agreed account terms, reports may be released in accordance with the agreed payment arrangement.


Use of Reports

Reports are prepared for the instructing client in relation to the specific issue, property and date of inspection.

They should not be relied upon for other purposes, later dates, different building conditions or by third parties without reference to Damp & Mould Solutions UK.

Acceptance or reliance upon any report by an insurer, managing agent, landlord, tenant, contractor or third party remains at their own discretion and risk.


Insurance Use of Reports

Where reports are requested for insurance purposes, Damp & Mould Solutions UK will provide findings based on the evidence available at the time of inspection.

No guarantee is given that any insurer will accept the report, approve a claim, adopt the recommendations or reimburse any costs.

Insurance decisions remain solely with the insurer.


Recommendations vs Remedial Works

Recommendations made during investigations are advisory in nature unless and until accepted as part of a separate quotation for remedial works.

No repair, remediation or drying work is included within an investigation fee unless explicitly stated.


Remedial Works

Where Damp & Mould Solutions UK provides a quotation for follow-on remedial works, those works will be limited to the items specifically described in the quote or written scope.

Any additional defects or related issues identified during the remedial works may require revised scope and additional cost approval.


Responsibility for Repairs

Where the source of a problem is identified and repair recommendations are provided, Damp & Mould Solutions UK may offer a separate quotation to carry out the recommended remedial works.

Where repair works are completed directly by Damp & Mould Solutions UK, those works will typically be covered by a 12-month workmanship warranty unless otherwise stated in writing.

The warranty applies only to the specific repair works carried out and does not extend to unrelated defects, pre-existing conditions, hidden issues or matters outside the agreed scope of works.

Clients are under no obligation to instruct Damp & Mould Solutions UK for remedial works and may appoint alternative contractors if they wish.

Where repairs are undertaken by third-party contractors, Damp & Mould Solutions UK accepts no responsibility for the quality, effectiveness, specification, sequencing or outcome of those repair works.


Workmanship Warranty

Any workmanship warranty provided by Damp & Mould Solutions UK applies only where:

  • the works have been paid for in full

  • the alleged defect relates directly to the original works completed by Damp & Mould Solutions UK

  • no third party has interfered with, altered or extended those works

  • the defect is reported within the stated warranty period

The warranty does not cover fair wear and tear, misuse, lack of maintenance, unrelated building defects, external events, tenant damage or changes in environmental conditions.


Third-Party Contractors

Where recommendations are implemented by others, Damp & Mould Solutions UK accepts no responsibility for workmanship, methods, omissions, delays or failures by third-party contractors.

The instructing client is responsible for ensuring the competence and suitability of any contractor they appoint.


Structural Drying and Monitoring

Where structural drying equipment is installed, drying times are estimates only and depend on material type, saturation levels, environmental conditions, ventilation, heating, power availability and ongoing moisture ingress.

Drying duration cannot be guaranteed.

Damp & Mould Solutions UK may recommend monitoring visits, repositioning of equipment or extended drying periods where necessary.


Drying Equipment Responsibility

Where drying or monitoring equipment is installed at a property, the client is responsible for ensuring that the equipment is not switched off, unplugged, tampered with, obstructed, moved or misused without authority.

Any loss of drying efficiency, delay, extra attendance or damage caused by interference, power interruption or misuse may result in additional charges.


Power Supply and Running Costs

Unless otherwise agreed, the property owner, tenant or instructing client is responsible for the cost of electricity required to operate drying or investigation equipment installed at the property.


Photos and Documentation

Damp & Mould Solutions UK may take photographs, video, moisture readings, thermal images, sketches, notes and other documentation during attendance for operational, reporting, evidential, quality control and record-keeping purposes.

These materials may be included in reports or shared with the instructing client in connection with the services provided.

They will not be used for marketing purposes without permission.


Appointment Times

Any appointment time or estimated arrival window is approximate only.

Attendance may be affected by traffic, emergencies, delays on previous jobs, weather, access issues or other operational factors.

Damp & Mould Solutions UK will make reasonable efforts to notify the site contact of significant delays, but shall not be liable for losses arising solely from revised arrival timing.


Additional Time and Unforeseen Work

Where additional time is required due to complexity, poor access, misinformation, hidden defects, unsafe conditions, waiting time, extended testing or unforeseen circumstances, Damp & Mould Solutions UK reserves the right to apply additional charges.

Where possible, this will be communicated before further chargeable time is incurred.


Abusive or Unsafe Conditions

Engineers may refuse, suspend or abandon attendance where conditions are unsafe or where they are subjected to abusive, threatening, discriminatory or aggressive behaviour.

In such cases, call-out and abortive attendance charges may still apply.


Tenant Conduct

Where the property is tenanted, the tenant or occupier must behave in a reasonable and cooperative manner and provide safe access to the instructed area.

Damp & Mould Solutions UK reserves the right to withdraw from site where tenant conduct prevents safe or reasonable completion of the services.


Cancellations and Rescheduling

Clients should provide as much notice as possible where an appointment needs to be cancelled or rescheduled.

Late cancellation, non-attendance, no-access situations or cancellation after engineer dispatch may result in a call-out or abortive visit charge.


Payment Terms

Payment may be requested in advance, on the day of attendance, upon completion, prior to release of the report, or in accordance with agreed account terms, depending on the nature of the service and client type.

Payments may be made by:

  • BACS / bank transfer

  • secure payment link

  • Stripe card payment

  • other agreed method

Unless otherwise agreed in writing, invoices are due upon receipt.

Damp & Mould Solutions UK reserves the right to require advance payment for certain bookings, new clients, higher value appointments, report-based services or clients with previous payment or access issues.


Two-Weekly Invoicing for Approved Clients

For repeat and approved clients, including certain landlords and property managers, Damp & Mould Solutions UK may offer a 14-day consolidated invoicing arrangement.

Under this arrangement, completed jobs carried out within the invoicing period may be grouped together and invoiced on a two-weekly basis.

This arrangement is offered at the sole discretion of Damp & Mould Solutions UK and may be withdrawn, amended or suspended where payment issues, account concerns or administrative difficulties arise.


Late Payment

Where payment is not made within the agreed timeframe, Damp & Mould Solutions UK reserves the right to suspend further bookings, withhold reports, withdraw account terms and take reasonable recovery action.

The client shall remain responsible for all outstanding sums properly due.


Booking Reference Requirements

Where a client operates a purchase order, works order, reference code, claim number or job reference system, that reference must be provided at the time of instruction.

Failure to provide correct billing or job reference details does not invalidate the client’s liability for the charges.

Force Majeure

Damp & Mould Solutions UK shall not be liable for delay or failure to perform services where caused by events outside its reasonable control, including but not limited to severe weather, transport disruption, utility failure, illness, accident, emergency call-out demand, labour shortage, access restrictions or other unforeseen operational events.


Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect.


Changes to Terms

Damp & Mould Solutions UK reserves the right to amend these Terms & Conditions from time to time.

The latest version published on the website shall apply unless otherwise agreed in writing.


Agreement

By instructing Damp & Mould Solutions UK to attend a property, investigate an issue, provide a report or undertake works, the client confirms that they have read, understood and accepted these Terms & Conditions.
